My Patent, What Happens Next?
6 to 8 Weeks After Filing
The first official action sent to you is a filing receipt;
date, application number, art group, name of applicant
and title of invention. It will also give you the preliminary
class number as well as the status of "Foreign
Filing License" with an explanation on the back
portion of the receipt.
Approximately 6 to 12 Months After Filing
The typical next step, if necessary, would be to receive
an "Office Action." This is when the Patent
& Trademark Office (PTO) states that other known
art was found in their patent search. The PTO can make
objections, request clarification and point out obviousness
concerning your patent application.
Approximately 6 to 18+ Months After Filing
If no other office actions are received, you will obtain
either a "Final Notice" or "Notice of
Allowance." If not already submitted, you must
submit formal drawings to the PTO along with the required
issuance fee. After satisfying this fee, you will receive
an "Issue Notification" in approximately four
to six weeks; your final patent will be sent in about
three to five day from the date listed on you issue
notification.
